Summary:
The Respondent was originally engaged for minor works, but convinced the Complainant to engage him for more and more work. He constructed replacement decks for the Complainant among other things, and these were not constructed in accordance with the Building Code and they did not have a building consent. The Respondent also did not appropriately treat and remove asbestos, which put the health of others in danger. A Quantity Surveyor provided expert commentary to the Board and it was established that the Respondent charged her almost double the estimated cost of work. The Board withheld their penalty decision and invited submissions from the Respondent on mitigating factors.
